2016 – Legal results

On the eve of the New Year Infralex traditionally has summed up the outgoing year. Infralex partners Artem Kukin, Alexey Popov and Artur Rokhlin have named the most important events in the legal area. The passing year is not marked by new fundamental laws, substantial precedents, “trials of the century”. The more notable amendments to the Russian Law will come into force on the 1st of January’2017: the new Law “On the State Registration of Real Estate”, the Law on titles to a car-parking space, the new provisions for challenging of companies’ transactions. These laws significantly affect the fundamentals of the economy and the regulation.

Appeal in the Federal Antimonopoly Service

The newspaper “Vedomosti” has published today the article by Infralex partner Artur Rokhlin with the headline “Appeal has required the expert review”. The author examines the first results of the Appeal in the Federal Antimonopoly Service (FAS). This new procedure has been in the first time provided by the “fourth antimonopoly package” came into force on the 5th of January’ 2016. First results indicate the success of the procedure: 36% of complaints were satisfied. According to Artur Rokhlin, the appeal procedure however needs improvement and support from the expert community.

Cartels: in focus again

Infralex has traditionally continued to examine the Russian Antitrust Law. In the regular annual issue of the International Comparative Legal Guide (ICLG) published in England Infralex partner Artur Rokhlin and associate Victor Fadeev gave their expert opinion on Cartel prohibition. The 10th ICLG edition with the headline «Cartels & Leniency 2017» covered 28 jurisdictions has been published in November. Infralex traditionally represents Russia. This year the experts continue to explore the amendments to the Competition Law came into force in January’2016.

Cartel agreement differs from other agreements

Infralex partner Artur Rokhlin has commented to the newspaper “KommersantЪ” on the law draft drawing a distinction between various breaches of competition and administrative responsibility for them. Catel agreements, the most dangers violations are proposed to punish more severe: the minimum fine shall be increase from 1% up to 3% of revenue. On the other hand administrative fine for other agreements can reduce from 15% up to 3-5% of revenue depending on the violation. Now all the anti-competitive agreements entail the same administrative penalty. Artur Rokhlin explained such the agreements as vertical ones and coordination.

Competition values shall be national values

Infralex partner Artur Rokhlin spoke yesterday at the VIIIth annual conference “Antimonopoly regulation in Russia” hosted by the newspaper “Vedomosti”. The speech by Artur Rokhlin was about the first results of the administrative appeal procedure in the Russian Federal Antimonopoly Service (FAS). This non-judicial procedure has been provided by the “fourth antimonopoly package” adopted last year. The antimonopoly conference traditionally attracts the leading experts in the Competition Law, the heads of the FAS make program statements. Yesterday the head of the FAS Igor Artemiev reported on the preparation of the Russian national plan for the competition development. It’s a decree of the Russian President that shall be an impulse for the national plan. The decree draft is now in a conciliation process.

Bulgaria investigates a fuel cartel

Infralex partner Artur Rokhlin has commented to the newspaper “KommersantЪ” on the Bulgaria’s complaints against Russia- and Europe-controlled oil companies operating in the Bulgarian fuel market. The companies are accused of a cartel agreement and overshooting of prices to petrol when oil prices have been falling. Artur Rokhlin noted that if the cartel agreement is proven the antimonopoly authority can fine the guilty companies up to the total amount of operating revenue.

Russian Competition Litigation withstands competition

On the 16th of September the next edition of the English annual “The International Comparative Legal Guide” (ICLG) has been published. It’s the 9th edition “Competition Litigation 2017”. Infralex partner Artur Rokhlin and associate Victor Fadeev represented Russia as experts in Russian Antitrust legislation – as well as a year ago in the 8th edition “Competition Litigation 2016”. The 9th edition covers 31 jurisdictions including Russia and follows a Q&A format. Recently Artur Rokhlin and Victor Fadeev gave their expert opinion on the Russian Antitrust Law for another English comparative annual - «The Strategic View» (Competition Litigation 2016).

«The Strategic View» to Competition Litigation

Infralex partner Artur Rokhlin and associate Victor Fadeev have become experts of the English annual «The Strategic View – Competition Litigation 2016». The experts from 18 jurisdictions answers the 10 questions mostly referred to competition damages actions. In this research Russia has been represented by Infralex. The various countries experts’ opinions given to uniform questions allow to explore the practical aspects of competition litigation in comparative perspective.

Stevedores will have free prices

Infralex senior associate Boris Galeev took part in the meeting of the Advisory Board by the Russian Federal Antimonopoly Service (FAS). The meeting discussed the price formation problems in Russian sea port terminals. The meeting moderated by the FAS Deputy Head Anatoly Golomolzin and the Deputy Minister of Transport took place on the 12th of August. Following the discussion the FAS agreed that the total tariff regulation shouldn’t be come back but it’s necessary to reveal the facts of monopoly abuses more scrupulous.
